CRWDEX Cancellation and No-Show Policy
1. Purpose and application
This policy sets out cancellation and no-show arrangements for confirmed crew bookings made through CRWDEX. It applies to boat owners and operators hiring crew (the Hirer) and crew members accepting bookings (the Crew Member).
CRWDEX is an online marketplace connecting boat owners/operators and crew Members. CRWDEX issues invoices on crews behalf. Boat owners/operators pay the crew directly, and pay CRWDEX’s service fee separately. CRWDEX does not collect crew payments or superannuation contributions.
This policy must be read in conjunction with CRWDEX’s terms and conditions.
2. Confirmed bookings and notice periods
Boat owners/operators can browse crew profiles on CRWDEX and send a booking request directly, or post a job on the job board for crew members to express their interest. Expressing interest in a job does not confirm a booking. A booking is only confirmed when the crew member accepts the boat owner/operator’s booking request through the platform.
Cancellation notice is measured backwards from the confirmed shift start time, using the location’s local time, including daylight saving where applicable. A booking accepted less than 48 hours before its start time will be immediately within the late-cancellation period.
3. Cancellations by the Owner/Operators
At least 48 hours before the shift designated start time
No crew cancellation payment or CRWDEX service fee is required for the cancelled booking.
Less than 48 hours before the shift
Subject to applicable legal rights and any exceptions under this policy: - The boat owner/operator owes the crew member a cancellation payment equal to two hours at the hourly rate agreed for that booking. - CRWDEX issues an invoice on the crew member’s behalf. The boat owner/operator pays the crew member directly using the payment details on the invoice. - CRWDEX’s service fee is calculated on the two-hour crew cancellation payment, using the service fee rate disclosed before booking confirmation. This fee is charged separately to the boat owner/operator and is not deducted from the crew member’s cancellation payment.
- Cancellations and no-shows by the Crew Member
Notification: Crew Members must notify the boat owner/operator and CRWDEX as soon as reasonably practicable if they cannot attend a confirmed booking. Payments and fees: If the Crew Member cancels before work starts or does not attend, the boat owner/operator owes no crew cancellation payment or CRWDEX service fee for that cancelled booking. Cancellation notice: Cancellations made at least 48 hours before the confirmed start time do not trigger a cancellation-related account review. Repeated cancellations with less than 48 hours’ notice or repeated no-shows may lead to account review, temporary suspension or removal from CRWDEX. No-shows: A no-show means failing to attend a confirmed shift without communicating a cancellation beforehand. Boat owners/operators should report suspected no-shows to CRWDEX promptly, including the agreed joining details and attempts to contact the Crew Member. Fair review: Before making an account decision, CRWDEX will give the Crew Member an opportunity to respond and consider the available records, their explanation, any emergency or communication difficulties, and the frequency and impact of previous incidents. Weather, emergencies and unsafe conditions will also be considered under Section 5. CRWDEX will explain its decision, and the Crew Member may request reconsideration by providing additional information. Replacement crew: The boat owner/operator may seek a replacement Crew Member through CRWDEX, but availability is not guaranteed. Any replacement requires a separate confirmed booking.
5. Weather, emergencies and unsafe conditions
Master’s authority The master has final authority over the vessel’s operational decisions, including whether to depart, continue, alter or stop a voyage for safety reasons, subject to applicable law. Decisions must consider weather conditions, vessel limitations, crew capability and the vessel’s Safety Management System (SMS), where applicable. AMSA — Master’s responsibilities
Crew safety concerns The crew must raise safety concerns with the master as soon as reasonably practicable. The master’s authority does not override a crew member’s legal right to refuse or stop unsafe work, or the safety responsibilities of other parties.
Notification If weather, an emergency or a safety concern prevents a booking from proceeding or continuing, the affected party must notify the other party and CRWDEX as soon as reasonably practicable, explaining the circumstances.
Individual assessment CRWDEX will assess each cancellation fairly on its individual merits, considering both parties’ accounts and relevant information. This may include weather forecasts and warnings, vessel conditions, the work required, notice provided and supporting evidence reasonably available. The master’s assessment will be considered but will not, by itself, determine whether cancellation charges apply.
Cancellation outcome Where circumstances reasonably justify an exception, CRWDEX may waive its own fees and apply any exceptions provided under the cancellation policy. Otherwise, the standard cancellation terms apply, subject to applicable law. Any cancellation payment owed to crew will be assessed separately under the agreed booking terms and applicable law. Waiving a CRWDEX fee does not automatically waive a payment owed to crew.
CRWDEX will communicate the outcome and reasons to both parties. Nothing in this section limits either party’s statutory rights.
6. Payments, corrections and disputes
Direct payment: The boat owner/operator remains responsible for paying the Crew Member directly. CRWDEX may assist with communication about overdue or disputed invoices but does not guarantee payment or recovery.
Invoices overdue by 30 days: If a crew invoice remains unpaid 30 days after its due date, CRWDEX will help facilitate communication between the Crew Member and the boat owner/operator to seek payment or clarify any dispute.
Disputing a cancellation or charge: Email crwdex@gmail.com with the booking reference, including the name, date and time, your reasons for disputing the cancellation or charge, and any supporting records. CRWDEX will give affected parties a reasonable opportunity to respond and explain its review outcome. This process does not prevent either party from exercising external complaints or legal rights.
Corrections and refunds: If CRWDEX charges a service fee in error, it will arrange the appropriate correction or refund. Where no service fee is payable, CRWDEX will arrange for any related card authorisation to be released. Bank processing times may affect when the release or refund appears in your account. Non-payment and account review: Repeated failure to pay overdue, undisputed crew cancellation invoices may lead to a review of the boat owner/operator’s account. Before suspension or removal, CRWDEX will consider the circumstances and give the account holder an opportunity to respond. A good-faith dispute alone will not be treated as non-payment misconduct. Account holders may request reconsideration by providing additional information.
